‘ฐากร ตัณฑสิทธิ์’ 2019 ATRC OTT Dialogue By Secretary General of NBTC

      ไทยเป็นเจ้าภาพจัดการประชุม 'ผู้นำองค์กรกำกับดูแลด้านโทรคมนาคมในภูมิภาคอาเซียน หรือ การประชุม ASEAN Telecommunication Regulator’s Council : ATRC ครั้งที่ 25โดยการประชุมในครั้งนี้ ได้หารือถึงบริการ โอเวอร์ เดอะ ท๊อป (โอทีที) ด้วย

      นายฐากร ตัณฑสิทธิ์ เลขาธิการคณะกรรมการกิจการกระจายเสียง กิจการโทรทัศน์ และกิจการโทรคมนาคมแห่งชาติ (กสทช.) กล่าวว่า การประชุมวันนี้ (19 ส.ค.) เป็นการประชุมเตรียมการ เพื่อนำข้อเสนอเข้าสู่ที่ประชุมในวันพรุ่งนี้ (20 ส.ค.) โดยผู้ให้บริการ OTT ได้เข้าร่วมประชุมถึง 5 ราย ได้แก่ เฟซบุ๊ก ไลน์ วอลท์ดิสนีย์ เน็ตฟลิกซ์ และอเมซอน

      ผมรู้สึกเป็นเกียรติและยินดีอย่างยิ่งที่ได้มาร่วมงาน 2019 ATRC OTT Dialogue ในวันนี้ ก่อนที่จะเริ่มงานในวันนี้ขอผมกล่าวถึงแนวทางที่จะพัฒนาอุตสาหกรรม OTT สักเล็กน้อย ในการประชุม OTT dialogue เมื่อปี 2017 ที่ผ่านมานั้น เราได้ทำการตกลงในหลักการเบื้องต้นเพื่อรองรับระบบการให้บริการ OTT (Over The Top) โดยมีการตกลงถึงการทำงานร่วมกันของภาคส่วนต่างๆ และการสร้างเงื่อนไขตลาดเพื่อให้เกิดการแข่งขันอย่างเท่าเทียม

       ยิ่งไปกว่านั้น ในการประชุม ATRC ที่สิงคโปร์เมื่อปี 2018 เราได้รับทราบถึงปัญหาการให้บริการ OTT ทั้งปัญหาทางด้านเศรษฐกิจและสังคม ซึ่งประเด็นดังกล่าวยังคงเป็นประเด็นที่เราให้ความสำคัญและได้มีการอภิปรายในการประชุม ATRC meetings ครั้งต่อๆ มา โดยมีการประชุมทั้งกับภาคส่วนอุตสหกรรมและภาครัฐ

      ธุรกิจ OTT นั้นสามารถสร้างผลประโยชน์ให้กับหลายภาคส่วนได้ในระยะเวลาที่รวดเร็วและมีต้นทุนการดำเนินงานที่คุ้มค่า เนื่องจากการดำเนินกิจกรรมต่างๆของ OTT เป็นการใช้งานผ่านทางโครงข่ายอินเตอร์เน็ต นอกจากการให้บริการ OTT จะสามารถลดค่าใช้จ่ายในการติดต่อสื่อสารได้แล้ว การให้บริการ OTT บางประเภทยังสามารถช่วยให้ผู้ประกอบการในท้องถิ่นเข้าถึงตลาดได้มากขึ้น ดังนั้น การสร้างระบบเศรษฐกิจที่เหมาะสม เพื่อผลักดันให้เกิดการใช้แพลตฟอร์ม OTT จึงเป็นสิ่งสำคัญอย่างยิ่ง

      ผมจึงอยากจะย้ำเน้นถึงความสำคัญของธุรกิจการให้บริการ OTT และประโยชน์ของ OTT ในประชาคมอาเซียน เราจะต้องร่วมกันค้นหาวิธีที่เหมาะสมเพื่อผลักดันให้เกิดสภาพแวดล้อมที่จะเอื้อต่อการให้บริการ OTT ในภูมิภาคอาเซียน โดยจะต้องจัดให้มีการแข่งขันอย่างเป็นธรรม การคุ้มครองผู้บริโภค และการคุ้มครองส่วนบุคคล

     การขยายตัวของบริการ OTT วันนี้สร้างความท้าทายให้กับผู้กำกับดูแลทั่วโลก เพราะมีประเด็นเชิงนโยบายมากมายตั้งแต่เรื่องการจัดเก็บภาษีของรัฐ ไปจนถึงเรื่องความรับผิดชอบต่อสังคม อาทิเช่นการคุ้มครองข้อมูลส่วนบุคคล การป้องกันการเผยแพร่ข้อมูลและการกระทำที่ขัดต่อกฎหมาย การจัดให้มีอภิปรายและการร่วมมือของผู้ที่มีส่วนได้ส่วนเสียที่เกี่ยวข้องซึ่งได้แก่ ภาครัฐ หน่วยงานกำกับดูแล ผู้ให้บริการเครือข่าย ผู้ให้บริการ OTT และผู้บริโภค จึงเป็นสิ่งสำคัญอย่างยิ่ง ในการแก้ไขปัญหาดังกล่าว

      แนวทางแก้ไขในอนาคต คือ การพัฒนาข้อเสนอแนะซึ่งผู้มีส่วนได้เสียทุกท่านตกลงร่วมกัน เพื่อให้เกิดการพัฒนาไปในทิศทางที่สอดคล้องกับความต้องการของทุกฝ่าย กรอบดังกล่าวจะเกิดขึ้นได้จากปัจจัยดังต่อไปนี้ ผู้บริโภค OTT จะต้องไม่ได้รับผลกระทบเชิงลบ เช่น ไม่ควรมีการผลักภาระให้ผู้บริโภคด้วยการเพิ่มราคา โดยเฉพาะแนวทางการเก็บภาษี เป็นต้น นอกจากนี้ ข้อเสนอแนะจะต้องก่อให้เกิดประโยชน์ต่อสังคม ทั้งนี้ ผู้ให้บริการ OTT อาจสนับสนุนเศรษฐกิจโดยการนำส่งรายได้เข้าสู่รัฐ ท้ายที่สุดแล้วผู้ให้บริการ OTT ควรได้รับแรงจูงใจให้ดำเนินการตามข้อเสนอแนะนี้ อาทิเช่น การจัดให้มีมาตรการคุ้มครองทางด้านกฎหมาย ซึ่งส่วนนี้ถือว่ามีความสำคัญมากเนื่องจากจะช่วยให้เกิดความร่วมมือจากทุกฝ่าย

       เศรษฐกิจแบบดั้งเดิมมีความไม่แน่นอนเพิ่มสูงขึ้น เศรษฐกิจใหม่จึงอยู่ในโลกออนไลน์มากขึ้น ทุกฝ่ายต้องยอมรับว่าธุรกิจ OTT เป็นแรงขับเคลื่อนหลักของโลกออนไลน์ ในโลกยุคดิจิทัลนี้ที่เทคโนโลยีเปลี่ยนแปลงรวดเร็ว เราจะต้องเริ่มต้นแก้ไขแนวทางกำกับดูแลก่อนที่จะสายเกินไป ทั้งนี้ ระบบนิเวศที่สนับสนุนผู้มีส่วนได้เสียทุกฝ่ายเป็นสิ่งที่จำเป็นอย่างยิ่ง

         ท้ายที่สุดนี้ ผมขอขอบคุณผู้ให้บริการ OTT และผู้แทนจากทุกภาคส่วนที่มาร่วมอภิปรายในวันนี้ ผมเชื่อว่าอาเซียนจะไม่ดำเนินการใดให้เกิดผลเสียต่อผู้ให้บริการ OTT เรายินดีรับฟังถึงความต้องการและข้อเสนอแนะที่จะเป็นประโยชน์ต่อการร่างหลักการที่ส่งให้เกิดผลดีต่อรัฐบาล ผู้ให้บริการและผู้บริโภค ผมเชื่อว่าธุรกิจ OTT ที่แข็งแกร่งจะช่วยส่งเสริมทั้งเศรษฐกิจในภูมิภาคและเศรษฐกิจโลก

         ผู้เข้าร่วมประชุมจากอาเซียนทุกท่านควรจะต้องพิจารณาปัจจัยทั้งสามประการที่ผมเสนอไว้เบื้องต้น อาจจะต้องมีการอภิปรายหรือการประชุมเพิ่มเติมหากจำเป็น ทั้งนี้ เพื่อให้เกิดระบบนิเวศที่เหมาะสม วางอยู่บนฐานนโยบายที่ดี และช่วยส่งเสริมธุรกิจ OTT เราควรจะร่วมมือกันสร้างความเปลี่ยนแปลงระหว่างที่ OTT ยังเป็นโอกาส ก่อนที่ OTT จะก่อให้เกิดความเสี่ยงต่อส่วนรวม

 

       It is my great honour to be here today and I would like to express gratitude towards all the delegates joining 2019 ATRC OTT Dialogue today. Before we begin our dialogue, please allow me to share some ideas to enhance the over-the-top or OTT businesses in our region. Since our OTT dialogue in 2017, we have agreed upon preliminary principles to endorse and enable a sound OTT ecosystem, namely cross-sector compliance and collaborative regulation, level playing field, and inclusion.

       Later on, we have acknowledged the challenges of OTT services in ASEAN in two aspects that are economic related and social issues as discussed by ASEAN Telecommunication Regulators’ Council meeting or ATRC last year in Singapore. The dialogue then continues to occur in parallel with the ATRC meetings where further development of relevant discussions is carried out as expected 2 times a year; one is the Industry-led and the other is the Government-led meeting. You may know that the Industry-led meeting was held in May this year whose outcome will be shared after my remarks and now we are in the Government-led OTT meeting.

        One of the facts about OTT businesses is that they can generate widespread and borderless benefits to different economies in an instance at a very fast and cost-effective way since their activities are being carried out over the internet. Some OTT services can reduce or even eliminate the cost of communications, while others can help local entrepreneurs expand and reach more markets generating more revenue. Therefore, it is always desirable for any economy to have the OTT business footprint.

Ladies and gentlemen,

         I would like to emphasise the important of OTT businesses and their benefits in ASEAN. In order to promote and mutually benefit from their activities, we need to collaborate closely and continuously to explore possible ways to provide suitable environment that strengthens their operation within the region. It is preferable to enhance their business activities to justify their presence in the face of fair competition, consumer protection, privacy, and contribution.

       It is highly encouraged that we overcome the challenges and concerns about OTT businesses being raised at global stage including economic contribution in terms of taxation or fees collection to the state as well as social responsibility such as the protection of personal data and distribution of illegal contents or conducts. These are of course the common concerns in all countries, not just ASEAN. To handle the challenges and concerns, it is required that an OTT business enabling ecosystem be provided based on fruitful discussion and active participation of relevant stakeholders that are the government or regulator, network provider, OTT service provider, and consumer.

                The way forward to solution of the desired ecosystem is to develop a mutually-agreed framework or guideline to provide a unified direction. In doing so, there are three key success factors to be considered. First, the consumers of OTT services should not be negatively affected. There should be no burden to the consumers in terms of rising service prices, especially when designing a taxation scheme. Second, the benefit to the country should be assured. Economic contribution from OTT businesses in the form of revenue to the state as obtained from non-OTT businesses is preferable to support the country. Additionally, positive social spillovers should be concretely visualised. Third, OTT businesses should also obtain certain benefits or incentives. This is vital, since it will ensure a smooth and willing cooperation. For example, one option can be the provision of regulatory protection as same as that of the offline competitors.

       As the traditional economy is becoming more and more unreliable, the new economy is growing online. We have to admit that OTT businesses are the engine of the online economy. In the world of technological and economic disruption, we need to move ahead first before it is too late. A supportive ecosystem for OTT businesses in ASEAN is needed.

       Finally, I would like to thank all OTT businesses and the representatives who join today’s dialogue. I do believe that ASEAN will not conduct anything that is against or considered harmful to OTT businesses, on the contrary, will listen to your demand and suggestions that can be used as guiding principles and applicable standards for ASEAN government or regulators, OTT service providers, and consumers to mutually benefit. In addition, I do believe that strong OTT businesses in ASEAN will not only drive the region’s economy forward, but also the global economy.

      All of us in ASEAN should consider the mentioned three factors together. Further discussions or meetings maybe necessary until the concrete ecosystem that will enhance OTT business activities is constructed and relevant policies are implemented. Let us work together towards a conclusion as soon as possible. Let us make a change while it is an opportunity before it becomes a risk.
